VANBERT Credit Policy

Effective Date: February 15, 2025

This Credit Policy outlines the terms and conditions governing the issuance, use, and transfer of credits by Vanbert Aviation Group LLC, VANBERT INC., and its affiliated entities (“VANBERT”). Credits may be issued by VANBERT or its Members (“Members”) and used towards air transportation services (a “Flight Booking”) and Membership Fees.

  1. Credit Types & Usage

1.1 Member-Generated Credits

  • Members can earn and redeem credits for the full cost of any whole aircraft charter, deal, or individual seat purchase.
  • Credits can be used for any available flight booked through the VANBERT mobile or web application, subject to applicable transaction fees.

1.2 Promotional Credits

  • VANBERT may issue promotional credits, which can be redeemed towards the full cost of a Flight Booking.
  • Promotional credits are also subject to transaction fees.

1.3 Refund Credits

  • If a flight is canceled, VANBERT will issue a Refund Credit via a code.
  • These credits can be applied to cover the full cost of a future Flight Booking.

2. Miscellaneous Terms

  • Non-Transferability: VANBERT credits cannot be transferred to other Members or third parties.
  • No Cash Value: Credits cannot be exchanged for cash or monetary value.
  • Eligible Purchases: Credits can only be earned on Flight Services and not on ancillary services or other offerings.

3. Credit Expiration

  • Credits automatically expire at the end of the Membership Term unless the Membership is renewed before expiration.
  • Expired credits cannot be transferred or used by non-members.

4. Policy Modifications & Amendments

  • VANBERT reserves the right to modify this Credit Policy at any time.
  • Any changes will be posted on the Website or Mobile Application.

Continued use of the VANBERT Services after modifications are posted constitutes acceptance of the updated terms.

VANBERT Terms and Conditions for Charter Services

  1. Introduction

These Terms and Conditions (“Terms”) govern charter services provided by Vanbert Aviation Group LLC dba VANBERT, VANBERT INC., and its affiliated entities (“VANBERT,” “we,” or “our”) to individuals or entities (“Customer” or “you”) requesting charter services.

IMPORTANT NOTICE: VANBERT IS AN AIR CHARTER BROKER, NOT A DIRECT AIR CARRIER. We do not operate aircraft; all flights are provided by approved Part 135 operators who have full operational control over flights (“Operators”).

Definitions

  • Booking – The arrangement, booking, or reservation of flights made by VANBERT on behalf of the Customer.
  • Charter Services – The booking and payment facilitation of flights made by VANBERT on behalf of the Customer.
  • Customer(s) – Individuals or entities booking flights, including passengers traveling under the booking.
  • Damage Fee – Costs associated with cleaning, repair, or replacement due to damage caused by the Customer.
  • Force Majeure – Unforeseen events beyond control, including natural disasters, war, government actions, or service outages.
  • Membership – A registered membership with VANBERT services via www.flyvanbert.com.
  • Quote – A pricing estimate provided by VANBERT for a charter flight, including fares, fees, and itinerary details.

Booking & Flight Services

3.1 Availability

  • Quotes are based on aircraft and crew availability.
  • Departure times may be adjusted based on Operator scheduling.
  • VANBERT is not responsible for schedule changes or cancellations due to weather, mechanical issues, or safety concerns.
  • Quotes are valid for 10 days unless the departure date is within 10 days, in which case, they are valid for 72 hours prior to departure.

3.2 Flight Confirmation

Bookings are NOT confirmed until full payment is received and a confirmation email is issued by VANBERT.

3.3 Flight Changes

  • Any departure time change requests are subject to availability and may alter pricing.

3.4 Brokers

  • If a broker books on behalf of passengers, the broker is fully responsible for all charges and federal tax remittance.

Fares & Payments

4.1 Payments

  • Full payment is required before departure via wire transfer, certified bank check, or credit card (+4% processing fee).
  • Additional services such as catering, lodging, and ground transportation incur a 10% surcharge.

4.2 Additional Charges

  • Customers are responsible for unexpected charges, including:
  • In-flight phone use
  • Aircraft de-icing
  • Hangar fees
  • Excess baggage fees
  • Customers must pay for any damage to the aircraft caused by their actions.

Cancellations & Refunds

  • Cancellation fees apply based on the timing of the cancellation:
  • More than 7 days before departure: 10% of Quote
  • 4-7 days before departure: 50% of Quote
  • 72 hours before departure: 75% of Quote
  • 24 hours before departure / No-show: 100% of Quote

One-way flights are non-refundable.

  • If a Customer delays departure by over 60 minutes, it is considered a cancellation.

Passenger Responsibilities

6.1 Conduct & Compliance

  • Passengers must comply with all Operator rules and crew instructions.
  • Passengers must have valid travel documents (e.g., passports, visas).
  • Prohibited Items: Items banned by the TSA are not permitted. For a full list, visit www.tsa.gov.
  • Misconduct (unsafe, illegal, or inappropriate behavior) may result in flight cancellation without refund.

6.2 Late Arrivals

  • Customers must arrive at least 30 minutes before departure.
  • Flights may depart early due to weather, restrictions, or crew requirements.
  • No refunds are issued for missed flights.

Flight Delays & Disruptions

7.1 Delays & Cancellations

  • VANBERT is not responsible for cancellations or delays due to weather, maintenance, or Force Majeure events.
  • We will attempt to arrange alternative flights, but Customers are responsible for any additional costs.

Limited Liability

  • VANBERT does not provide transportation services and is not responsible for third-party Operator compliance or safety.
  • Customers waive any claims against VANBERT related to:
  • Third-party flight operations
  • Service quality
  • Transportation safety risks
  • Customers assume full risk in booking services through VANBERT.

Governing Law & Disputes

  • This Agreement is governed by the laws of the United States and The Bahamas.
  • Any disputes shall be resolved in the courts of The Bahamas or the United States, and Customers waive their right to a jury trial.

Assignment & Notices

  • Customers cannot transfer this Agreement without VANBERT’s written consent.
  • Notices should be sent to:

  • Survival & Miscellaneous
  • Sections related to liability, governing law, and dispute resolution will remain in effect even after termination of the Agreement.

This Agreement constitutes the entire contract between the Customer and VANBERT.
